GENERAL TERMS AND SALE CONDITIONS
1. PREAMBLE
These conditions are intended to define the rights and obligations between atelierpuka.com and its clients.
They apply to any person visiting and / or purchasing (hereinafter referred to as the Client) an item offered for sale on the site atelierpuka.com
2. ACCEPTANCE OF THE GENERAL CONDITIONS OF SALE
The present conditions can be consulted by the Client at any time by clicking on the general terms and sales conditions heading.
Consequently, the Client acknowledges having read, at the time of placing his/her order, the special conditions of sale set out on this screen and expressly declares his/her unreserved acceptance of them.
The general conditions of sale shall prevail over any other conditions appearing in any other document.
3. CAPACITY TO CONTRACT
The Client guarantees that he/she is fully authorized to use the bank card he/she is using, that it is a personal card and that it has not been used fraudulently.
The Client must declare that he/she is at least eighteen years of age and has the legal capacity, or holds legal authorization, to access and purchase online. Atelierpuka.com reserves the right to refuse an order from a Client with whom there is a dispute.
4. PRESENTATION AND DESCRIPTION OF THE PRODUCTS
On its website, Atelier PUKA presents various Products for sale along with their detailed descriptions appearing on the Site, offering the Client the chance to find out, before placing an order, the key characteristics about each Product that he/she may buy from the Site.
In this respect, Atelier PUKA takes the utmost care to ensure that the color, design and presentation of the Products, pictures that are displayed on the Site, are faithful to the original Products.
However, given the method of presenting the Products on the Site, it is possible that the appearance perceived by the Client of the photographic representation of the Products does not correspond exactly to the product itself. The photos, texts, graphics, information reproduced and illustrating the Products do not fall within the contractual scope.
Atelier PUKA cannot be held responsible in the event an error between the Products’ characteristics and their representation.
5. PRICE
The price is expressed in euros.
The price indicated on the product sheets does not include transport.
The price indicated in the order confirmation is the final price, including all taxes for France. This price includes the price of the products, handling, packaging and transport costs. Atelierpuka.com reserves the right to modify its prices at any time. In the event of a modification, the price invoiced to the Client is the one indicated on the order form and accepted by the Client at the time of validation.
Products remain the exclusive property of atelierpuka.com until full payment has been received. Prices are not negotiable.
6. PRODUCTS AVAILABILITY
Product offers are valid as long as they are visible on the Site within the limits of available stocks. atelierpuka.com will do its best to process all orders.
In the event of unavailability of the product after placing the order, the Client will be informed by mail. The Client’s order will be automatically cancelled and the amount paid by the Client for the missing item will be credited to the Client’s bank account within a maximum of fifteen (15) days.
7. PRODUCT ORDERING
While browsing the Site, the Client has the opportunity to freely take note of the Products offered for sale on the Site at the time of his/her consultation.
In order to place an order, the Client clicks on “Add to Cart”, at any moment, the Client may :
- obtain a summary of the Products he/she has selected or modify his/her order by clicking on the Cart accessible on each page
- complete his/her Product selection and pay for his/her order by clicking on “checkout”
The content of the basket will be definitively allocated to the Client after he/she has validated his/her basket and his/her delivery address, subject to the availability of the items.
The automatic recording systems are considered valid proof of the nature, content and date of the order. Atelierpuka.com confirms acceptance of the order to the Client at the email address provided. The sale will be concluded upon confirmation of the order. Atelierpuka.com reserves the right to cancel any order from a Client with whom there is a dispute over payment of a previous order.
The information provided by the Client when placing the order is binding: in the event of an error in the recipient's contact details, the seller cannot be held responsible for the impossibility of delivering the product. In this case, all costs incurred for the return shipment will be charged to the Client.
8. PAYMENT
To pay for the Products the Client has selected, he/she clicks on “Checkout”. An order summary will then appear on the screen. If the list shown matches the Products selected, the Client validates the summary by clicking on “Proceed to Checkout”.
Payment for the Products ordered takes place immediately over the Internet according to the instructions given for this purpose during the order validation process.
Payment will be made exclusively in Euros.
Payment can be made by :
• PayPal / Bank Card
The online payment system allows the Client to pay via the PayPal bank server or his/her Bank Card in a secure environment. The order validated by the Client will only be considered effective once the relevant bank payment centers have given their approval. In the event of refusal by the said centers, the order will be automatically cancelled and the Client will be informed by e-mail.
9. SECURITY / CONFIDENTIALITY
The credit card number is directed to the servers of the bank, the payment is made directly to a bank without passing through the server of the store, this in order to ensure the customer that its numbers are known only by the banking partner of atelierpuka.com.
Atelierpuka.com never has access to confidential information relating to the means of payment.
For this reason, the Client’s bank details will be requested for each new order.
GDPR: Only the data strictly necessary for the transaction to run smoothly (name, address, e-mail and telephone number) are collected. They are preserved on a personal basis and not used except for very rare mailings to which you can unsubscribe. Credit card payments are not processed directly by the site, but by secure means such as Paypal, so we have no access to your bank details.

10. DELIVERY
Once the order has been placed, the Client will receive an e-mail at the Internet address indicated in the order form, specifying the details of the order and its registration.
The Products ordered by the Client on the Site will be delivered exclusively in :
• Metropolitan France, Corsica, Monaco & Andorra.
• Overseas France / Zone OM 1 & OM2
• E.U, Switzerland, Norway (shipping costs to be reconsidered according to French Poste's "International zone A" rates)
• Maroc Zone B / Canada et Etats-unis zone C
Shipping costs are calculated as accurately as possible according to the weight and size of your order. They include packaging, handling and postage.
Atelier PUKA reminds you that it is the Client responsibility to inspect their packages upon receipt in the presence of the delivery person and to notify the carrier and Atelier PUKA of any anomaly (damaged package, delivery date that does not comply with the normal delivery service deadlines) within two working days. In the absence of any reservations, the product is deemed to have been accepted by the Client and may not be the subject of any dispute concerning its delivery. Atelier PUKA reminds the Client that transport risks are supported by the Client.
In the event of a delay in delivery in relation to the times announced by the carrier, the Client must contact the carrier as a matter of priority, in order to see if the package is not pending. If this is the case, the Client must lodge a reasoned protest with the postal services within three working days of the expected delivery date, in order to open a dispute or investigation file to search for the package.
11. WITHDRAWALS AND RETURNS
In accordance with the Macron law, the Client has a period of 14 days, from the date of receipt of the goods, to retract without giving any reason. This right is exercised by returning the product, with shipping costs to be paid by the customer.
After this period, the products delivered will be in conformity and accepted by the customer, Atelier PUKA reserves the right to refuse the exchange or refund.
It is the Client’s responsibility to keep all proof of this return and its date, and therefore to send the package by registered mail.
In the event of exercising the right of withdrawal, atelierpuka.com is obliged to reimburse the purchase price of the product(s) purchased and returned, free of charge, with the exception of the return postage, which remains the responsibility of the Client. The refund (amount of the product + initial shipping costs) is due within a maximum of 14 working days from the date the Client informs us of his/her wish to be refunded.
It should be noted that this time limit will be respected if the goods are recovered by Atelier PUKA within 14 working days, the refund may be deferred until full recovery of the items.
Items returned incomplete, damaged or deteriorated cannot be taken back by atelierpuka.com.
Products made to specifications taken by the Client or personalized (sizes outside the sizes indicated in the site) are excluded from the right of withdrawal.The right of withdrawal is exercised under the same conditions from the order, before delivery.
12. PERSONAL INFORMATION
The data collected are confidential and atelierpuka.com undertakes not to communicate, free of charge or with consideration, the details of the Client to a third party.
13. MODIFICATION OF THE GENERAL TERMS AND SALE CONDITIONS
Atelierpuka.com reserves the right to modify these Terms and Conditions at any time.
The Client is therefore invited to consult them regularly.
By validating his/her orders, he/she accepts the new terms of the General Terms and Sale Conditions.
14. LIABILITY, DISPUTES AND COMPETENT COURT
This contract is governed by French law. Atelierpuka.com cannot be held responsible for damages of any kind, whether material, immaterial or bodily, which may result from malfunction or misuse of the products sold.
The responsibility of atelierpuka.com will be, in any case, limited to the amount of the order and could not be questioned for simple errors or omissions which could have remained in spite of all the precautions taken in the presentation of the products.
15. INTELLECTUAL PROPERTY
All elements of the atelierpuka.com site, whether visual or graphic, are protected by copyright, trademarks or patents. They are the exclusive property of Atelier PUKA. Consequently, the partial or total reproduction, on any medium whatsoever, of the elements making up the atelierpuka.com site, their use and their provision to third parties are strictly forbidden.

CONDITIONS GENERALES DE VENTE
1. PREAMBULE
Les présentes conditions ont pour objet de définir les droits et obligations qui unissent atelierpuka.com et ses clients.
Elles s’appliquent à toute personne visitant et/ou achetant (ci-après dénommé le Client) un article proposé à la vente sur le site atelierpuka.com
2. ACCEPTATION DES CONDITIONS
Les présentes conditions sont consultables à tout moment par le Client en cliquant sur la rubrique conditions générales de vente.
Par conséquent, le Client reconnaît avoir pris connaissance, au moment de la passation de sa commande, des conditions particulières de vente énoncées sur cet écran et déclare expressément les accepter sans réserve.
Les conditions générales de vente prévaudront sur toutes autres conditions figurant dans tout autre document.
3. CAPACITE A CONTRACTER
Le Client garantit qu’il est pleinement habilité à utiliser la carte bancaire dont il fait usage, qu’il s’agit d’une carte personnelle et qu’il ne s’agit pas d’une carte frauduleusement utilisée.
Le Client doit déclarer être âgé d’au moins dix-huit ans et avoir la capacité juridique, ou être titulaire d’une autorisation juridique, lui permettant l’accès et l’achat en ligne. Atelierpuka.com se réserve le droit de refuser une commande d’un Client avec lequel il existe un litige.
4. PRESENTATION ET DESCRIPTION DES PRODUITS
Atelier PUKA présente sur son site internet les différents produits offerts à la commercialisation, ainsi que leurs descriptifs détaillés, offrant la possibilité au Client, avant la prise de commande, de connaître les caractéristiques essentielles de chaque produit qu’il peut acheter via le site.
A cet égard, Atelier PUKA prend le plus grand soin à ce que la couleur, le motif et la présentation des produits dont les photographies sont affichées sur le Site soient fidèles aux produits originaux.
Toutefois, eu égard au mode de présentation des produits sur le réseau Internet, il est possible que l’impression perçue par le Client de la représentation photographique des produits ne corresponde pas avec exactitude au produit en lui-même.
Les photographies, textes, graphiques, informations reproduites et illustrant les produits n’entrent pas dans le champ contractuel.
En cas d’erreur entre les caractéristiques des produits et leur représentation, Atelier PUKA ne saurait voir sa responsabilité engagée.
5. PRIX
Le prix est exprimé en euros.
Le prix indiqué sur les fiches produit ne comprend pas le transport.
Le prix indiqué dans la confirmation de commande est le prix définitif, exprimé toutes taxes comprises pour la France. Ce prix comprend le prix des produits, les frais de manutention, d’emballage des produits, les frais de transport. Atelierpuka.com se réserve le droit de modifier ses prix à tout moment. Dans le cas d’une modification, le prix facturé au Client est celui inscrit dans le bon de commande et accepté par le Client au moment de sa validation.
Les produits demeurent la propriété exclusive de atelierpuka.com jusqu’au paiement complet de la marchandise. Les prix ne sont pas négociables.
6. DISPONIBILITE DES PRODUITS
Les offres de produits sont valables tant qu’elles sont visibles sur le site dans la limite des stocks disponibles. Atelierpuka.com fera son possible pour traiter toutes les commandes. Cependant, dans l’éventualité d’une indisponibilité du produit après passation de la commande, le Client en sera informé par mail. La commande du Client sera automatiquement annulée et la somme payée par le client pour l’article manquant sera créditée sous quinze (15) jours maximum sur son compte en banque.
7. COMMANDE
En naviguant sur le Site, le Client a la possibilité de prendre librement connaissance des produits proposés à la vente sur le Site, au moment de leur consultation.
Afin de passer commande, le Client cliquera sur l’icône “Add to Cart”.
A tout moment, le Client pourra :
- obtenir un récapitulatif des Produits qu’il a sélectionnés ou modifier sa commande, en cliquant sur “Cart” accessible sur chaque page
- terminer sa sélection de produits et régler sa commande en cliquant sur “Checkout”
Le contenu du panier sera définitivement attribué au Client après que celui-ci ait validé son panier et son adresse de livraison, sous réserve de la disponibilité des articles.
Les systèmes d’enregistrement automatique sont considérés comme valant preuve, de la nature, du contenu et de la date de la commande. Atelierpuka.com confirme l’acceptation de sa commande au Client à l’adresse mail que celui-ci aura communiqué. La vente ne sera conclue qu’à compter de la confirmation de la commande. Atelierpuka.com se réserve le droit d’annuler toute commande d’un Client avec lequel existerait un litige relatif au paiement d’une commande antérieure. Les informations énoncées par le Client, lors de la prise de la commande engagent celui-ci : en cas d’erreur dans le libellé des coordonnées du destinataire, le vendeur ne saurait être tenu pour responsable de l’impossibilité de livrer le produit. Dans ce contexte, tous les frais engagés pour la réexpédition seront à la charge du Client.
8. PAIEMENT
Pour payer les Produits qu'il a sélectionnés, le Client clique sur "Checkout". Un récapitulatif de la commande apparaît alors à l'écran. Si la liste affichée correspond aux Produits sélectionnés, le Client valide le récapitulatif en cliquant sur "Proceed to Checkout”.
Le paiement des Produits commandés s'effectue immédiatement sur Internet selon les instructions données à cet effet lors du processus de validation de la commande.
Le paiement s'effectue exclusivement en euros.
Le paiement peut être effectué par :
• PayPal / Bank Card
Le système de paiement en ligne permet au Client de payer via le serveur bancaire PayPal ou sa Carte Bancaire dans un environnement sécurisé. La commande validée par le Client ne sera considérée comme effective que lorsque les centres de paiement bancaire concernés auront donné leur accord. En cas de refus desdits centres, la commande sera automatiquement annulée et le Client en sera informé par courrier électronique.
9. SÉCURITÉ / CONFIDENTIALITÉ
Le numéro de carte bancaire est dirigé vers les serveurs de la banque, le paiement est effectué directement à une banque sans passer par le serveur du Site, ceci afin de garantir au client que ses numéros ne sont connus que par le partenaire bancaire de atelierpuka.com.
Atelierpuka.com n'a jamais accès aux informations confidentielles relatives aux moyens de paiement.
C'est pourquoi les coordonnées bancaires du Client lui seront demandées à chaque nouvelle commande.
GDPR : Seules les données strictement nécessaires au bon déroulement de la transaction (nom, adresse, e-mail et numéro de téléphone) sont collectées. Elles sont conservées à titre personnel et ne sont pas utilisées sauf pour de très rares mailings auxquels vous pouvez vous désinscrire.
Si vous ne souhaitez plus figurer dans nos fichiers clients, veuillez nous envoyer un e-mail afin que nous puissions supprimer vos données à l'adresse info@atelierpuka.com.
10. LIVRAISON
Une fois la commande passée, le Client recevra un courrier électronique à l'adresse Internet indiquée dans le formulaire de commande, précisant les détails de la commande et son enregistrement.
Les Produits commandés par le Client sur le Site seront livrés exclusivement en :
- France métropolitaine, Corse, Monaco & Andorre.
- France Métropolitaine / Zone OM 1 & OM2
- U.E., Suisse, Norvège (frais de port à reconsidérer selon les tarifs de la Poste "zone internationale A")
- Maroc Zone B / Canada et Etats-unis zone C
Les frais de port sont calculés au plus juste en fonction du poids et de la taille de votre commande. Ils comprennent l'emballage, la manutention et les frais de port.
Atelier PUKA rappelle qu'il appartient au Client de vérifier son colis à réception en présence du livreur et de signaler au transporteur et à Atelier PUKA toute anomalie (colis endommagé, date de livraison non conforme aux délais habituels du service de livraison) dans les deux jours ouvrés. En l'absence de réserves, le produit est réputé accepté par le Client et ne pourra faire l'objet d'aucune contestation concernant sa livraison. Atelier PUKA rappelle que les risques liés au transport sont supportés par le Client.
En cas de retard de livraison par rapport aux délais annoncés par le transporteur, le Client doit contacter en priorité le transporteur afin de vérifier si le colis n'est pas en instance. Si tel est le cas, le Client doit formuler une protestation motivée auprès des services postaux dans un délai de trois jours ouvrables à compter de la date de livraison prévue, afin d'ouvrir un dossier de litige ou d'enquête pour rechercher le colis.
11. RÉTRACTATIONS ET RETOURS
Conformément à la loi Macron, le Client dispose d'un délai de 14 jours, à compter de la date de réception de la marchandise, pour se rétracter sans donner de motif. Ce droit s'exerce par le renvoi du produit, les frais de port étant à la charge du client.
Passé ce délai, si les produits livrés sont conformes et acceptés par le client, Atelier PUKA se réserve le droit de refuser l'échange ou le remboursement.
Il appartient au Client de conserver toute preuve de ce retour et de sa date, et donc d'envoyer le colis en recommandé.
En cas d'exercice du droit de rétractation, atelierpuka.com est tenu au remboursement du prix d'achat du ou des produits achetés et retournés, sans frais, à l'exception des frais de retour qui restent à la charge du Client. Le remboursement (montant du produit + frais de port initiaux) est dû dans un délai maximum de 14 jours ouvrables à compter de la date à laquelle le Client nous informe de son souhait d'être remboursé.
A noter que ce délai sera respecté si la marchandise est récupérée par Atelier PUKA dans les 14 jours ouvrés, le remboursement pouvant être différé jusqu'à récupération complète des articles.
Les articles retournés incomplets, abîmés, endommagés ou détériorés ne seront pas repris par atelierpuka.com.
Les produits confectionnés selon les spécifications prises par le Client ou personnalisés (tailles en dehors des tailles indiquées sur le site) sont exclus du droit de rétractation. Le droit de rétractation s'exerce dans les mêmes conditions à compter de la commande, avant la livraison.
12. INFORMATIONS NOMINATIVES
Les données collectées sont confidentielles et atelierpuka.com s'engage à ne pas communiquer, gratuitement ou avec contrepartie, les coordonnées du Client à un tiers.
13. MODIFICATION DES CONDITIONS GENERALES DE VENTE
Atelierpuka.com se réserve le droit de modifier à tout moment les présentes Conditions Générales de Vente.
Le Client est donc invité à les consulter régulièrement.
En validant ses commandes, il accepte les nouveaux termes des Conditions Générales de Vente.
14. RESPONSABILITÉ, LITIGES ET JURIDICTION COMPÉTENTE
Le présent contrat est soumis à la loi française. Atelierpuka.com ne peut être tenu pour responsable des dommages de toute nature, tant matériels qu'immatériels ou corporels, qui pourraient résulter d'un mauvais fonctionnement ou de la mauvaise utilisation des produits commercialisés.
La responsabilité de atelierpuka.com sera, en tout état de cause, limitée au montant de la commande et ne saurait être mise en cause pour de simples erreurs ou omissions qui auraient pu subsister malgré toutes les précautions prises dans la présentation des produits.
15. PROPRIÉTÉ INTELLECTUELLE
Tous les éléments du site atelierpuka.com, qu'ils soient visuels ou graphiques, sont protégés par le droit d'auteur, des marques ou des brevets. Ils sont la propriété exclusive de Atelier PUKA. En conséquence, la reproduction partielle ou totale, sur quelque support que ce soit, des éléments composant le site atelierpuka.com, leur utilisation et leur mise à disposition de tiers sont strictement interdites.
