GENERAL TERMS AND SALE CONDITIONS
1. PREAMBLE
These conditions are intended to define the rights and obligations between atelierpuka.com and its clients.
They apply to any person visiting and / or purchasing (hereinafter referred to as the Client) an item offered for sale on the site atelierpuka.com
2. ACCEPTANCE OF THE GENERAL CONDITIONS OF SALE
The present conditions can be consulted by the Client at any time by clicking on the general terms and sales conditions heading.
Consequently, the Client acknowledges having read, at the time of placing his/her order, the special conditions of sale set out on this screen and expressly declares his/her unreserved acceptance of them.
The general conditions of sale shall prevail over any other conditions appearing in any other document.
3. CAPACITY TO CONTRACT
The Client guarantees that he/she is fully authorized to use the bank card he/she is using, that it is a personal card and that it has not been used fraudulently.
The Client must declare that he/she is at least eighteen years of age and has the legal capacity, or holds legal authorization, to access and purchase online. Atelierpuka.com reserves the right to refuse an order from a Client with whom there is a dispute.
4. PRESENTATION AND DESCRIPTION OF THE PRODUCTS
On its website, Atelier PUKA presents various Products for sale along with their detailed descriptions appearing on the Site, offering the Client the chance to find out, before placing an order, the key characteristics about each Product that he/she may buy from the Site.
In this respect, Atelier PUKA takes the utmost care to ensure that the color, design and presentation of the Products, pictures that are displayed on the Site, are faithful to the original Products.
However, given the method of presenting the Products on the Site, it is possible that the appearance perceived by the Client of the photographic representation of the Products does not correspond exactly to the product itself. The photos, texts, graphics, information reproduced and illustrating the Products do not fall within the contractual scope.
Atelier PUKA cannot be held responsible in the event an error between the Products’ characteristics and their representation.
5. PRICE
The price is expressed in euros.
The price indicated on the product sheets does not include transport.
The price indicated in the order confirmation is the final price, including all taxes for France. This price includes the price of the products, handling, packaging and transport costs. Atelierpuka.com reserves the right to modify its prices at any time. In the event of a modification, the price invoiced to the Client is the one indicated on the order form and accepted by the Client at the time of validation.
Products remain the exclusive property of atelierpuka.com until full payment has been received. Prices are not negotiable.
6. PRODUCTS AVAILABILITY
Product offers are valid as long as they are visible on the Site within the limits of available stocks. atelierpuka.com will do its best to process all orders.
In the event of unavailability of the product after placing the order, the Client will be informed by mail. The Client’s order will be automatically cancelled and the amount paid by the Client for the missing item will be credited to the Client’s bank account within a maximum of fifteen (15) days.
7. PRODUCT ORDERING
While browsing the Site, the Client has the opportunity to freely take note of the Products offered for sale on the Site at the time of his/her consultation.
In order to place an order, the Client clicks on “Add to Cart”, at any moment, the Client may :
- obtain a summary of the Products he/she has selected or modify his/her order by clicking on the Cart accessible on each page
- complete his/her Product selection and pay for his/her order by clicking on “checkout”
The content of the basket will be definitively allocated to the Client after he/she has validated his/her basket and his/her delivery address, subject to the availability of the items.
The automatic recording systems are considered valid proof of the nature, content and date of the order. Atelierpuka.com confirms acceptance of the order to the Client at the email address provided. The sale will be concluded upon confirmation of the order. Atelierpuka.com reserves the right to cancel any order from a Client with whom there is a dispute over payment of a previous order.
The information provided by the Client when placing the order is binding: in the event of an error in the recipient's contact details, the seller cannot be held responsible for the impossibility of delivering the product. In this case, all costs incurred for the return shipment will be charged to the Client.
8. PAYMENT
To pay for the Products the Client has selected, he/she clicks on “Checkout”. An order summary will then appear on the screen. If the list shown matches the Products selected, the Client validates the summary by clicking on “Proceed to Checkout”.
Payment for the Products ordered takes place immediately over the Internet according to the instructions given for this purpose during the order validation process.
Payment will be made exclusively in Euros.
Payment can be made by :
• PayPal / Bank Card
The online payment system allows the Client to pay via the PayPal bank server or his/her Bank Card in a secure environment. The order validated by the Client will only be considered effective once the relevant bank payment centers have given their approval. In the event of refusal by the said centers, the order will be automatically cancelled and the Client will be informed by e-mail.
9. SECURITY / CONFIDENTIALITY
The credit card number is directed to the servers of the bank, the payment is made directly to a bank without passing through the server of the store, this in order to ensure the customer that its numbers are known only by the banking partner of atelierpuka.com.
Atelierpuka.com never has access to confidential information relating to the means of payment.
For this reason, the Client’s bank details will be requested for each new order.
GDPR: Only the data strictly necessary for the transaction to run smoothly (name, address, e-mail and telephone number) are collected. They are preserved on a personal basis and not used except for very rare mailings to which you can unsubscribe. Credit card payments are not processed directly by the site, but by secure means such as Paypal, so we have no access to your bank details.

10. DELIVERY
Once the order has been placed, the Client will receive an e-mail at the Internet address indicated in the order form, specifying the details of the order and its registration.
The Products ordered by the Client on the Site will be delivered exclusively in :
• Metropolitan France, Corsica, Monaco & Andorra.
• Overseas France / Zone OM 1 & OM2
• E.U, Switzerland, Norway (shipping costs to be reconsidered according to French Poste's "International zone A" rates)
• Maroc Zone B / Canada et Etats-unis zone C
Shipping costs are calculated as accurately as possible according to the weight and size of your order. They include packaging, handling and postage.
Atelier PUKA reminds you that it is the Client responsibility to inspect their packages upon receipt in the presence of the delivery person and to notify the carrier and Atelier PUKA of any anomaly (damaged package, delivery date that does not comply with the normal delivery service deadlines) within two working days. In the absence of any reservations, the product is deemed to have been accepted by the Client and may not be the subject of any dispute concerning its delivery. Atelier PUKA reminds the Client that transport risks are supported by the Client.
In the event of a delay in delivery in relation to the times announced by the carrier, the Client must contact the carrier as a matter of priority, in order to see if the package is not pending. If this is the case, the Client must lodge a reasoned protest with the postal services within three working days of the expected delivery date, in order to open a dispute or investigation file to search for the package.
11. WITHDRAWALS AND RETURNS
In accordance with the Macron law, the Client has a period of 14 days, from the date of receipt of the goods, to retract without giving any reason. This right is exercised by returning the product, with shipping costs to be paid by the customer.
After this period, the products delivered will be in conformity and accepted by the customer, Atelier PUKA reserves the right to refuse the exchange or refund.
It is the Client’s responsibility to keep all proof of this return and its date, and therefore to send the package by registered mail.
In the event of exercising the right of withdrawal, atelierpuka.com is obliged to reimburse the purchase price of the product(s) purchased and returned, free of charge, with the exception of the return postage, which remains the responsibility of the Client. The refund (amount of the product + initial shipping costs) is due within a maximum of 14 working days from the date the Client informs us of his/her wish to be refunded.
It should be noted that this time limit will be respected if the goods are recovered by Atelier PUKA within 14 working days, the refund may be deferred until full recovery of the items.
Items returned incomplete, damaged or deteriorated cannot be taken back by atelierpuka.com.
Products made to specifications taken by the Client or personalized (sizes outside the sizes indicated in the site) are excluded from the right of withdrawal.The right of withdrawal is exercised under the same conditions from the order, before delivery.
12. PERSONAL INFORMATION
The data collected are confidential and atelierpuka.com undertakes not to communicate, free of charge or with consideration, the details of the Client to a third party.
13. MODIFICATION OF THE GENERAL TERMS AND SALE CONDITIONS
Atelierpuka.com reserves the right to modify these Terms and Conditions at any time.
The Client is therefore invited to consult them regularly.
By validating his/her orders, he/she accepts the new terms of the General Terms and Sale Conditions.
14. LIABILITY, DISPUTES AND COMPETENT COURT
This contract is governed by French law. Atelierpuka.com cannot be held responsible for damages of any kind, whether material, immaterial or bodily, which may result from malfunction or misuse of the products sold.
The responsibility of atelierpuka.com will be, in any case, limited to the amount of the order and could not be questioned for simple errors or omissions which could have remained in spite of all the precautions taken in the presentation of the products.
15. INTELLECTUAL PROPERTY
All elements of the atelierpuka.com site, whether visual or graphic, are protected by copyright, trademarks or patents. They are the exclusive property of Atelier PUKA. Consequently, the partial or total reproduction, on any medium whatsoever, of the elements making up the atelierpuka.com site, their use and their provision to third parties are strictly forbidden.
